These Terms of Service ("Terms") govern access to evermiora.com and purchases from EverMiora ("we," "us," or "our"). By using the website or placing an order, you agree to these Terms and the policies linked from them.

1. Eligibility and lawful use

You must be able to form a binding contract in your place of residence to place an order. You may not use the website, products or services for an unlawful, fraudulent or abusive purpose, interfere with website security, or violate another person's intellectual-property, privacy or publicity rights.

2. Store platform

Our store is hosted by Shopify, which provides the ecommerce platform used to offer products and process orders. Payment, hosting and other functions may also be provided by third parties under their own terms and privacy practices.

3. Product information and availability

We try to present product descriptions, images, prices and availability accurately. Screen settings and the personalized nature of the work may cause reasonable visual differences. We may correct errors, limit quantities, refuse an order or cancel an unavailable order. If we cancel a paid order, we will issue the refund required by applicable law.

Unverified material, production or delivery claims are not part of the sale unless they appear in the product information or order confirmation at the time of purchase.

4. Orders, payment and taxes

You agree to provide accurate billing, contact, personalization and shipping information. Prices are shown in U.S. dollars unless stated otherwise. Applicable tax and shipping charges are displayed during checkout when available.

An order confirmation acknowledges receipt of the order; it does not waive our right to review the order for payment, fraud, photo usability, legal compliance or production feasibility. We will contact you if more information or a different photo is required.

5. Customer photos and content

You retain ownership of photos and original content you submit. You represent that you own the content or have permission to use it for the order, and that our fulfillment of the order will not violate another person's copyright, trademark, privacy, publicity or other rights.

You grant us and our production and service providers a limited, non-exclusive license to store, crop, edit, reproduce and transmit the submitted content only as reasonably necessary to design, preview, produce, deliver and support your order, maintain required business records, prevent fraud and comply with law.

This license does not authorize us to use your pet photo, story or finished design in advertising, social media or other public marketing. We will request separate, explicit permission for that use.

6. Proofs, revisions and approval

The personalized workflow, included revision and approval requirements are described on the product page and in the Refund Policy.

You are responsible for checking names, dates, spelling, composition, crop, selected product and options before approval. Production begins only after clear approval. Once approved, changes or cancellations may not be possible.

7. Intellectual property

The website, brand elements, layout, copy, templates and original store artwork are owned by us or used under license and are protected by applicable intellectual-property law. Purchasing a physical product does not transfer our underlying template, production file or commercial reproduction rights.

Your submitted photo remains subject to Section 5. The personalized physical product is intended for personal use unless we agree otherwise in writing.

8. Shipping, cancellations, replacements and refunds

Our Shipping Policy and Refund Policy are incorporated into these Terms. If these Terms conflict with a non-waivable legal right, the legal right controls.

9. Third-party links and services

The website may link to or use third-party services. We are not responsible for an unaffiliated third party's content or practices, but this clause does not limit responsibility that applicable law places on us for our own sale or fulfillment obligations.

10. Disclaimer and limitation of liability

To the maximum extent permitted by law, the website is provided on an "as available" basis. We do not promise uninterrupted or error-free website access.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from website use or an order. Our aggregate liability relating to a product will not exceed the amount paid for that product, except where applicable law does not permit that limitation. Nothing in these Terms excludes liability that cannot legally be excluded.

11. Customer responsibility for submitted content

To the extent permitted by law, you are responsible for third-party claims arising from content you submitted without the necessary rights, your unlawful use of the website, or your material breach of these Terms. This does not make you responsible for our own negligence, willful misconduct or violation of law.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy. Order photos and personalization details may contain personal information and will be handled according to that policy and Section 5 of these Terms.

13. Applicable law and consumer rights

These Terms are subject to applicable law. Mandatory consumer-protection rights that apply in a customer's place of residence are not excluded by these Terms.

14. Changes and severability

We may update these Terms by posting a revised version and effective date. Changes do not retroactively remove rights already attached to an order. If a provision is unenforceable, the remaining provisions continue to the extent allowed by law.

15. Entire agreement

These Terms, the order confirmation and the policies linked from them form the agreement concerning the website and your purchase, except for any written term we expressly agree with you.
